1. Acceptance of Terms
By accessing and using BloomWave's services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Service Description
BloomWave provides AI-powered lead generation and social media integration services. Our platform helps businesses identify, target, and engage with qualified prospects through automated marketing campaigns and analytics.
3. User Accounts and Registration
To access certain features of our service, you may be required to provide information about yourself. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
4. Payment Terms
BloomWave operates on a performance-based pricing model where you pay only for qualified leads that respond to your campaigns. Payment terms are as follows:
- Social Media Leads: $40 per replied lead
- Search & Display Ads: $50 per replied lead
- Premium Channels: $60 per replied lead
Invoices are generated monthly and payment is due within 30 days of invoice date.
5. Lead Quality Guarantee
We guarantee that all charged leads meet our qualification criteria: prospects who respond to your initial outreach within 30 days via email, phone, or contact form, showing genuine interest in your product or service.
6. Data Privacy and Security
We are committed to protecting your privacy and the privacy of your customers. All data is encrypted using industry-standard AES-256 encryption. We comply with GDPR, CCPA, and other applicable data protection regulations.
7. Intellectual Property
The service and its original content, features, and functionality are and will remain the exclusive property of BloomWave and its licensors. The service is protected by copyright, trademark, and other laws.
8. Prohibited Uses
You may not use our service:
- For any unlawful purpose or to solicit others to perform unlawful acts
- To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
- To infringe upon or violate our intellectual property rights or the intellectual property rights of others
- To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
- To submit false or misleading information
- To upload or transmit viruses or any other type of malicious code
9. Service Availability
We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We reserve the right to modify or discontinue the service at any time with reasonable notice.
10. Limitation of Liability
In no event shall BloomWave, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.
11. Termination
We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
12. Governing Law
These Terms shall be interpreted and governed by the laws of the State of New Mexico, United States, without regard to its conflict of law provisions.
13. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
